1. Responsibilities

In the course of its business operations, if Prime Commerce collects consumers’ personal information, it shall ensure full compliance with the provisions of Decree No. 72/2013/ND-CP and all applicable laws and regulations relating to the protection of personal information.

Prime Commerce is responsible for ensuring the security of all personal information collected and stored by implementing appropriate measures to prevent the following:

  • Theft or unauthorized access to personal information.
  • Unauthorized use of personal information.
  • Unauthorized modification or destruction of personal information.

Commitment to Protecting Customers’ Personal Information

Prime Commerce is committed to safeguarding customers’ personal information collected through primecommerce.asia in accordance with the Company’s Personal Data Protection Policy. The collection and use of personal information shall only be carried out with the customer’s consent, except where otherwise required or permitted by applicable law.

Prime Commerce is committed to the following:

  • Not to use, transfer, disclose, or provide customers’ personal information to any third party without the customer’s prior consent, except as required by applicable law.
  • In the event that the information system or server is compromised by unauthorized access, resulting in the loss of customers’ personal data, Prime Commerce will promptly notify the relevant authorities for investigation and resolution, and inform affected customers in accordance with applicable laws.
  • To maintain strict confidentiality of all customers’ online transaction information, including accounting invoices and digitized transaction records, which are securely stored within Prime Commerce’s Level 1 secure data center.
  • Customers are required to provide complete and accurate personal information, including but not limited to: full name, correspondence address, email address, national identification number, telephone number, bank account number, and payment card details. Customers are solely responsible for the legality and accuracy of the information provided. Prime Commerce shall not be liable for, nor resolve, any claims relating to customer rights or interests if the information submitted during registration is found to be inaccurate, incomplete, or false.

Scope of Use of Personal Information

Prime Commerce is committed to using customers’ personal information solely for the purpose of providing products and services. Customers’ personal information shall only be used for the purposes and within the scope previously notified to customers, except in the following circumstances:

  • To comply with applicable laws and regulations.
  • Such use may include the sharing, disclosure, or transfer of personal information to authorized third parties where required by law.
  • Where required by law, Prime Commerce shall cooperate with competent authorities by providing customers’ personal information upon lawful request from judicial authorities, including the People’s Procuracy, Courts, Police Investigation Agencies, or other competent authorities in connection with investigations or legal proceedings involving violations of the law. Except as otherwise provided by law, no organization or individual has the right to unlawfully access or interfere with customers’ personal information.
  • In all other cases, Prime Commerce will provide prior notice to customers before disclosing personal information to any third party. Such disclosure will only be made after obtaining the customer’s consent.

Data Retention Period

Customers’ personal data will be retained until Prime Commerce receives a request for deletion from the customer or until the customer logs into their account and deletes the information themselves.

In all other cases, customers’ personal information will be securely stored on Prime Commerce’s servers.

Persons Authorized to Access Personal Information

Access to customers’ personal information is strictly limited to:

  • Prime Commerce’s authorized administrators;
  • Employees or departments directly involved in customer support or the performance of contractual obligations.

Where required by law, Prime Commerce shall provide customers’ personal information to competent judicial or law enforcement authorities upon lawful request. Except for such legally required disclosures, no person or organization is permitted to access or interfere with customers’ personal information without authorization.

Accessing and Updating Personal Information

Customers have the right to access, review, update, correct, or delete their personal information by logging into their account on primecommerce.asia and selecting the “Personal Information” section.

  • Personal information will be clearly displayed to customers before or at the time of collection.
  • Where personal information is collected through Prime Commerce’s e-commerce website, the Personal Data Protection Policy will be published in a prominent and easily accessible location on primecommerce.asia.

2.Review, Update and Correction of Personal Information

Customers have the right to request Prime Commerce to review, update, correct, or delete their personal information.

Prime Commerce shall process such requests promptly or provide customers with the necessary tools to access, review, update, correct, or delete their personal information independently.

Customers may also access, edit, and update their information directly through their account management functions after logging into the website.

Prime Commerce shall not be responsible for the accuracy, completeness, or legality of any information voluntarily provided or uploaded by customers.
